1 · Who we are
AIGNCY LLC, a Florida limited liability company.

From everyone who visits the Sites:
- IP address, browser type, device information, referring URL
- Cookie data (see Cookies Policy)
When you submit a Talent application (apply.gncy.ai):
- Name, email, phone number, Telegram handle
- Social platform handles (Instagram, TikTok, OnlyFans, X, etc.) and follower/subscriber metrics
- Self-reported revenue, content focus, and contact preferences
- Anything else you choose to include
When you submit a Partner application (apply.gncy.ai):
- Name, email, company name
- Partnership type, budget range, contact information
- Project or business details you share with us
When you email or otherwise contact us:
- The contents of your message and any attachments
We do not knowingly collect data from anyone under 18. The Sites are for adults only.
3 · How we use it
We use the information above to:
- Review and respond to applications and inquiries
- Operate, maintain, and improve the Sites
- Send service-related communications (application confirmations, updates about your inquiry)
- Send marketing communications, where you've opted in (unsubscribe anytime)
- Protect against fraud, abuse, and security threats
- Meet legal and regulatory obligations
We do not sell your personal data. We do not share it with advertisers.
4 · Who we share it with
We rely on vetted third-party services to operate the business. Each has a Data Processing Agreement with us and is contractually required to handle your data securely. Our current processors include:
- Cloudflare — hosting, CDN, security
- Airtable — application data storage and CRM
- SendGrid (Twilio) — transactional and marketing email
- Google Analytics — site analytics, anonymized (when active)
We may also disclose information when legally required (subpoena, court order, regulatory request) or to protect the rights, safety, or property of AIGNCY, our users, or the public.
If AIGNCY is acquired or merges with another entity, your data may transfer as part of that transaction. We'll notify you if that happens.
5 · How long we keep it
We retain application data for as long as we have an active business interest, not to exceed seven (7) years after our last interaction with you. After that, we delete or anonymize it.
You can request earlier deletion at any time (see section 6).
6 · Your rights
Depending on where you live, you may have the right to:
- Access the data we hold about you
- Correct inaccurate data
- Delete your data ("right to be forgotten")
- Restrict or object to how we process it
- Receive a copy of your data in a portable format
- Withdraw consent for marketing communications
- Lodge a complaint with your local data protection authority

California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know the categories of personal information we collect and the right to opt out of any "sale" of personal information. We do not sell personal information.

AIGNCY is based in the United States. If you're outside the US, your data will be transferred to and processed in the US. By using the Sites, you consent to this transfer.
Our processors maintain appropriate safeguards for international transfers, including Standard Contractual Clauses where applicable.

The Sites are marketing properties for AIGNCY's three verticals:
- AIGNCY Studio — AI content generation software
- AIGNCY Media — creator growth and marketing services
- AIGNCY Talent — creator management services
The Sites provide information about our services and forms to apply for or inquire about them.
Submitting an application or inquiry does not create a contract or business relationship. Acceptance into AIGNCY's services requires a separately signed agreement.
3 · Application submissions
When you submit an application (Talent, Partner, or otherwise):
- You confirm the information you provide is accurate
- You authorize us to review and verify it
- You understand we may decline applications at our discretion without explanation
- You acknowledge submission does not guarantee acceptance, payment, or any future business relationship
4 · Acceptable use
You agree not to:
- Use the Sites to violate any law or regulation
- Submit false, misleading, or fraudulent information
- Impersonate another person or entity
- Interfere with the operation, security, or availability of the Sites
- Attempt to access non-public areas of our systems
- Scrape, harvest, or extract data from the Sites without our written permission
- Upload viruses, malware, or other harmful code
- Use the Sites to harass, threaten, or harm others
5 · Intellectual property
All content on the Sites — text, graphics, logos, code, brand assets, the PRISM-1 mark, design system, and underlying technology — is owned by AIGNCY LLC or our licensors and protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works without our prior written permission.
When you submit an application, you grant us a non-exclusive license to use the information you provide for the purposes described in our Privacy Policy.
6 · AIGNCY Media — disclaimers
Marketing and growth services offered through AIGNCY Media are provided on a best-effort basis. We do not guarantee any specific outcome, including:
- Follower growth, subscriber growth, or revenue increases
- Performance on third-party platforms (Instagram, TikTok, Reddit, OnlyFans, X, etc.)
- Compliance outcomes with third-party platform terms or policies
Specific service deliverables, timelines, and payment terms are governed by separately signed engagement agreements between you and AIGNCY.
Nothing on the Sites constitutes financial, legal, tax, or investment advice.
7 · Third-party links and services
The Sites may contain links to third-party websites or services we do not control. We are not responsible for their content, policies, or practices. Your interactions with third parties are between you and them.
8 · Disclaimer of warranties
The Sites are provided "as is" and "as available." To the maximum extent permitted by law, AIGNCY disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Sites will be uninterrupted, error-free, or secure.
9 · Limitation of liability
To the maximum extent permitted by law, AIGNCY's total liability arising out of or related to your use of the Sites is limited to the greater of $100 USD or the total amount you've paid to AIGNCY in the twelve (12) months preceding the claim.
AIGNCY will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption — even if advised of the possibility.
Some jurisdictions don't allow these limitations, in which case they apply to the maximum extent permitted by law.
10 · Indemnification
You agree to indemnify and hold harmless AIGNCY, its officers, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Sites, violation of these Terms, or violation of any third-party rights.
11 · Termination
We may suspend or terminate your access to the Sites at any time, for any reason, without notice. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
12 · Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any disputes arising out of or related to these Terms will be resolved through binding arbitration in Pinellas County, Florida, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.
